International law tools: SANT'ANNA school dirpolis institute (law, politics, development) director gives a lecture in beijing on methods of dispute settlement in the international community
On July 13 in Beijing, Andea de Guttry, professor of international law and director of Sant’Anna School DIRPOLIS Institute will give a lecture on how International Law tools can be used to resolve dispute in the international community. Upon the invitation of Beijing Municipal Public Defender Office, Professor de Guttry will focus on the employment of different methods of dispute settlement that include negotiation, and mediation, conciliation, arbitration and judicial settlement.
This lecture is designed to advance the interdisciplinary discussion of transnational justice issues, addressing current ethical, legal and social issues in the Post-Cold War era. International commercial disputes are today regularly resolved through arbitration since international (public and private) law is viewed as network of relationships. States and organizations recognize common principles and international arbitration is increasingly recognized as a “legal order” for the application of foreign law.
Over the past twenty years, more than 800 disputes have been resolved through the international arbitral process. National courts may intervene at the end of the process for purposes of the enforcement or review. According to Professor Andrea de Guttry, negotiation and conciliation are some of disputes settlement approaches in international relations that may be used as an effective tool for dispute management. Such approach, as de Guttry notes, “depend on a certain degree of goodwill and flexibility but international arbitration (before the Permanent Court of Arbitration or the International Centre for Settlement of Investment Disputes) is becoming more and more acceptable and plays an important role that can bring greater global stability and security”.
